El Garito® Terms & Conditions

The following are the terms of use (“Terms”) that govern your use of the websites and applications where this appears (collectively, the “Site”). Our Privacy Policy and any other policies, rules or guidelines that may be applicable to particular offers or features on the Site are also incorporated into these Terms. By visiting or using the Site, you expressly agree to these Terms, as updated from time to time.

We may make changes to these Terms at any time. Any changes we make will be effective immediately when we post a revised version of these Terms on the Site. By continuing to use this Site after that date, you agree to the changes.

The Site is not targeted at anyone under the age of 18, and they are not permitted to use the Site. We strongly encourage all parents and guardians to monitor Internet use by their children. If you use the Site, you affirm you are at least 18 years old.

Ticket Package Orders

Ticket packages are sold on a first come first served basis and while quantities last. It is your responsibility to check your order. If you do not receive a confirmation number (in the form of a confirmation page or email) after submitting payment information, or if you experience an error message or service interruption after submitting payment information, it is your responsibility to confirm whether or not your order has been placed. Only you may be aware of any problems that may occur during the purchase process. We will not be responsible for losses (monetary or otherwise) if you assume that an order was not placed because you failed to receive confirmation.If after submitting your order you realize that you made a mistake, and you are within 24 hours from the time you submitted the order, you can email customer service at info@elgaritotama.com. A 15% handling fee will be deducted from any monies we may agree to refund to you in connection with any such mistake.

Pricing and Other Errors

If the amount you pay for a ticket is incorrect regardless of whether because of an error in a price posted on this Site or otherwise communicated to you, or you are able to order a ticket before its scheduled on-sale or presale date or you are able to order a ticket that was not supposed to have been released for sale, then we will have the right to cancel that ticket (or the order for that ticket) and refund to you the amount that you paid. This will apply regardless of whether because of human error or a transactional malfunction of this website.

Currency

All ticket prices are in U.S. Dollars and are inclusive of taxes unless otherwise stated.

Resale and Promotions​

Resale of ticket packages is expressly prohibited. Photo identification will be required at the time of delivery for each person named on an order. Tickets may not be used for advertising, promotions, contests or sweepstakes unless formal written authorization is given by us.

Billing Information Verification

Orders are processed only after a billing address and other billing information have been verified. Occasionally, we receive incorrect billing or credit card account information for a ticket package order that can delay processing. In these cases, customer service will attempt to contact you, using the information provided at the time of purchase. If we are unable to reach you after our initial attempt, we may cancel your order and may sell your ticket package to another customer without further notice.

Refunds & Cancellations

At El Garito, we strive to provide an exceptional experience for all of our guests. Our refunds and cancellations policy applies to VIP table reservations, private events, group reservations, open-bar reservations, general entry tickets, and ticket packages to ensure clarity and fairness.

 

  1. General Policy 
    Refunds are generally not issued for VIP table reservations, private events, group bookings, open-bar reservations or general entry tickets and ticket packages. However, we understand that unforeseen circumstances may arise. If you believe you have a legitimate reason for requesting a refund (such as pregnancy, serious injury, or illness preventing travel), we encourage you to contact us as soon as possible to discuss your situation.

 

  1. Deposits for Event Bookings
    For private events, group reservations, and open-bar bookings, a 50% non-refundable deposit is required to secure your reservation. This deposit is non-refundable under any circumstances. The final payment may be eligible for a refund depending on the timing of your cancellation and the specific circumstances, which will be considered on a case-by-case basis.

 

  1. Cancellation Terms
    Refunds may be available depending on the timing of your cancellation:
    • Full Refunds: Cancellations made at least 14 days prior to the reservation date are eligible for a full refund, minus any associated non-refundable processing fees.
    • No Refunds: Cancellations made 13 days or less prior to the reservation date will not be eligible for a refund.

*Please note that all refunds are processed within 20 business days after approval.

 

  1. Non-Transferable Tickets & Reservations
    All general entry tickets, ticket packages, VIP table reservations, and event bookings (private, group, or open-bar) are non-transferable. They are also non-refundable except in limited circumstances, such as a canceled event. In the event of a cancellation initiated by El Garito, we will refund the face value of the tickets or reservations.

 

  1. VIP Table Arrival & Group Conduct
    VIP table guests must arrive by 12:00 AM to retain their reservation. Failure to do so may result in the table being re-sold without eligibility for a refund. We kindly ask all guests, especially those in groups, to avoid excessive pre-event alcohol consumption. If any individual within your group is deemed intoxicated, entry may be denied for the entire group.

 

    1. Personal Belongings & Venue Capacity
      El Garito is not responsible for any loss or damage to personal belongings. We advise guests to take full responsibility for their items while at the venue. Additionally, El Garito does not guarantee a specific number of attendees or a full venue for any event. Refunds will not be issued based on the number of attendees, the perceived busyness of the event, weather conditions, or any other extenuating circumstances outside of the venue’s control.

 

  1. Right of Refusal & Removal
    At El Garito, the safety and enjoyment of all patrons is our top priority. We reserve the right to deny entry or remove any individual from the premises for any reason, including but not limited to:
    • Behaving in a dangerous or unruly manner
    • Exhibiting signs of excessive intoxication
    • Failing to comply with any of our established policies, guidlines, or regulations

Our staff is fully empowered to make these decisions in the interest of maintaining a safe and enjoyable environment for all guests. By entering the premises, you agree to abide by these terms and understand that no refunds will be issued due to refusal of entry or removal from premises.


You agree that you will not attempt to evade, avoid, or circumvent any refund prohibitions in any manner with regard to tickets, ticket packages, VIP table reservations, and/or any type of event reservations (private, group, and/or open-bar) you purchased. Customer agrees and understands that the charges on a credit card for any items purchased through the Site (owned by 3102670855 SOCIEDAD DE RESPONSABILIDAD LIMITADA) are irrevocable, undisputable and may not be charged back, contested or challenged now or in the future, doing so is a material breach of this agreement for which 3102670855 SOCIEDAD DE RESPONSABILIDAD LIMITADA would be entitled to attorney fees, costs and fees associated with addressing a chargeback in addition to the amount challenged. 3102670855 SOCIEDAD DE RESPONSABILIDAD LIMITADA shall have at its sole disposal any other legal remedy it independently chooses to pursue any collection against Customer for the cost of the chargeback. Customer further agrees that proof of purchase by 3102670855 SOCIEDAD DE RESPONSABILIDAD LIMITADA is all that is necessary to establish to the credit card agency or banking institution to deny a chargeback to Customer.

Payment Methods

We accept PayPal, Direct Bank Transfer (SINPE Costa Rica), American Express, Visa, MasterCard and Discover as methods of payment. Bank Transfers must be completed immediately in order to hold your ticket package. Order ID must be used as the payment reference. Tickets, reservations and ticket packages will not be held until the funds have been transferred.

Postponed or Rescheduled Events

If an event is postponed or rescheduled, the tickets will be honored for the rescheduled event date. New tickets will not be issued for most rescheduled events or postponements. We will not refund you for postponed or rescheduled events.

Opening Acts and Festival Performers

Opening acts or guests may sometimes tour with headlining performers or other attractions. We are not always made aware of opening acts or the length of their performances. Opening acts, as well as festival performers, are subject to change or cancellation at any time without notice. We will not provide a refund if an opening act or festival performer is changed or canceled. If your event ticket is for a sponsored concert series with multiple feature performers, and there is a partial cancellation or change in artists performing in that concert series, we will not provide a refund.

Claims of Copyright Infringement on the Site

It is our policy to terminate, in appropriate circumstances, the access rights to the Site of repeat infringers.
